Terms & Conditions

 

1. 1. Any reference in these conditions to "we", "us" and "our or ours", refers to Premiere Bonsai.  "You" and "your" refers to any customers placing orders with us or requiring information.
You can get in touch with us at premierbonsai@hotmail.co.uk, this is where we deal with any orders, enquiries or complaints.

1.2. Your Statutory rights as a consumer are not affected

1.3. English law applies to all our terms and conditions.

2.1  When you place an order with us, you are confirming that you are 18 years old or over and so therefore you are legally able to enter into a binding contract. We reserve the right not to accept an order.  Once we have accepted your order that is when the contract and these terms and conditions come into force.

2.2 Sale of sharp objects:-
We will not supply scissors, knives, blades or any sharp edge tools to any persons who are under 18 years old.  When you do purchase any such items then you are confirming that you are 18 years old or over and that you are complying with The
Offensive Weapons Act 1996.  If we are in any doubt as to your age then physical evidence would be asked from you by us.  If this proof could not be met and payment had been made then we would refund your money minus any administration costs.

3.1  We try considerably hard to make sure that all our prices and descriptions of our products are correct.  If any prices or product information changes, or any other error occurs then we will get in touch with you as soon as possible, we will give you the choice of cancelling your order and any monies returned in full to you, or you can go ahead with the order with the revised item or price.

3.2  All the information given with our products is a general guide.  You are responsible for reading the information and safety instructions, if given, then you can decide if it is the right item for you.

3.3  When purchasing your product you will also see our delivery charges and payment methods.  Prices may include a handling or administration fee.  Delivery charges may change, but we will inform you if this happens.

4.  We do require full payment from you before we despatch any goods.
All goods which we supply will remain our property until they have been paid for in full including all delivery costs.

If you cancel an order for any reason before we have despatched it, then a full refund will be given.  For credit card and PayPal payments there will be a 2% handling charge.  If you do wish to cancel your order you need to email us at the address given in Clause 1.  You can cancel your order up to 7 working days after the day you receive your order and you will be responsible for the cost of returning the goods to us.  We will refund your money when we get the items back in a good re saleable condition less the outgoing carriage costs and a 2% handling fee.

5.  We always try to have your goods purchased from us delivered to you as soon as possible, but any dates given by us as to when you will receive your parcel are an estimate.  If you do not receive your goods within a week of any date we have given, then you must let us know.  If for any reason we could not despatch your order within 30 days we would understand if you wanted to cancel your order and a full refund would be given.
We are not liable for any delivery delay which is beyond our control or any business losses.  We are not liable or accept no responsibility for losses incurred for any delays imposed by International Customs Services where we have supplied all the requested documentation.

6.  When you do receive your order and you have checked it, you should let us know if there are any problems within 7 days of receipt of your order.  Please keep all the packaging if possible until you are completely satisfied with your order as it makes any returns easier.  You are responsible for any loss or damage to the order which happens after it is delivered to you.

7.  When the Latin names for our plants are stated, these are correct to the best of our knowledge. Once the plants leave us we do not accept responsibility for the performance of the plant as environmental and cultural conditions are beyond our control.  Any information or guidance we give you for plants is only a guide.  Foliage on any plant can change depending on the season and conditions so may not always match the photographs we take, but we do try to keep the pictures up to date. 

There are some restrictions regarding bonsai trees, they are as follows :-

8.1  BONSAI TREES CANNOT BE SENT OUTSIDE THE EUROPEAN UNION.

8.2  If any trees are purchased outside the EU then a refund will be given minus a 5% handling fee.

8.3 If you are not sure if you can receive trees you can email us at the address in Clause 1 and we can advise you to the best of our knowledge.

9. Once your order is shipped you will get a tracking number, if you wish to then track your order you can.  We do not track orders of customers.  You can't track a parcel if we have used Royal Mail.

10.  All measurements we give are approximate, there can be some variance due to manufacturing processes + or- 10%.  If you do require exact measurements you can email us at the address in Clause 1.

Data Protection

We will only use your information for credit and security purposes and to enable us to manage your account.

Returns

When we have correctly supplied your goods and you decide to return due to unsuitability the following conditions apply :-
The returned item must be unused.
Goods must be returned within 7 working days from receipt of the goods.
As with all returns you need to contact us so we can give you the returns information.
As at Clause 6, It is best to keep the original packaging as to make your returns safer in transit, goods need to be in an unused and saleable condition for you to receive your full refund.
We reserve the right to charge for any repackaging where applicable.
All carrier charges for unwanted items will be your responsibility.
We will not accept any damages caused by your carrier.
In your return you need to provide proof of purchase and your Order reference number, your name, address, telephone number and email. Details of why you are returning the goods too.

If you are returning goods due to a mistake on our part then we will ask that you either return them or we will arrange collection and that you return them in original packaging as soon as possible.  We will cover any costs you incur in this situation.

Do not make any returns until you have contacted us first.

Incomplete Orders

If your order is incomplete please contact us within 7 days and we will get the order completed as soon as possible.  Back orders that are "to follow" are not incomplete orders. These will be with you soon after.

Delayed or Lost Parcels

99% of all parcels do eventually arrive.
We use either Royal Mail, Parcelforce and Hermes for our parcel deliveries.
You are not able to track Royal Mail parcels, their transit time is variable.  We will let you know when we have sent your parcel via email.  As we have no way of knowing where your parcel is, if there are any delays there is nothing we can do in the short term, most parcels being delivered in the UK by Royal Mail usually arrive within 14 days of dispatch.
International orders can take longer, it is not usual but can sometimes happen especially outside the EU for parcels to take several weeks to arrive.
A parcel is only classed as lost once 8 weeks has passed since the date of dispatch, if this happens we will give a full refund.  Although if the delay is due to local customs then we cannot be held responsible for any charges or for items returned to us.

With our other couriers you can see where your parcel is with the tracking information we give you and so you would see any delays.

If your parcel is delayed or lost, as soon as you let us know we can start a search for the parcel.  If this is not successful then the courier officially tells us the parcel is lost and then we can make a claim and issue your refund.  This can take a while so we do ask for your patience.

It is your responsibility to make sure you can receive the goods you order depending on what country you are in.  Any goods seized or returned by customs WILL NOT be refunded or any shipping or charges incurred. 


Damaged Goods

If you can see that your parcel is damaged you should either refuse delivery or sign for the goods as damaged and get in touch with us immediately.
If you find damaged goods once you open the parcel you need to take clear photos and email them for us to see so we can decide what action needs to be taken. 
We cannot replace or refund without photographic evidence.
We cannot replace or refund if the goods have been used.


Nothing in these terms and conditions affect your statutory rights.
